These Terms of Service (“Terms,” “Agreement”) constitute a legally binding agreement between you (“User,” “Client,” “you”) and 17467184 Canada Inc. governing your access to and use of our digital taxi dispatching website, mobile application, and related services (collectively, the “Service”).
By registering for, accessing, browsing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
1746714 Canada Inc. provides a digital platform that connects registered users (“Clients”) with independent third-party taxi providers (“Drivers”) in the user’s region. Our Service facilitates the booking, dispatching, and payment of taxi fares for transportation from a pick-up point (“Point A”) to a destination (“Point B”). We are a technology service provider, not a transportation carrier. The Drivers are independent contractors and are not employees, agents, or partners of 174671 Canada Inc.
3. User Registration and Account
To use all features of the Service, you must register for an account. You agree to:
a. Provide accurate, current, and complete information during registration.
b. Maintain and promptly update your account information to keep it accurate.
c. Maintain the security of your password and accept all risks of unauthorized access.
d. Notify us immediately if you discover or suspect any security breaches related to the Service.
e. Be responsible for all activities that occur under your account.
4. Membership and Fees
a. Free Service: The core dispatching service—booking and paying for a taxi from Point A to Point B—is free for all registered users. You only pay the fare for your ride directly through our processed payment system.
b. Membership Tier: We offer an optional premium membership tier (“Membership”) that may provide benefits such as quick stops, pickup with no address, or other features.
c. Recurring Billing: By signing up for a Membership, you authorize us to charge your chosen payment method on a recurring basis for the subscription fees. You can cancel your Membership at any time through your account settings.
5. Payments and Fare Charges
You agree to pay the full fare for each ride you book through the Service. The fare is determined based on factors such as distance, time, and local rates, and is displayed to you before you confirm your booking. By confirming the booking, you agree to pay the displayed fare. All payments are processed securely through our third-party payment processors. You agree to abide by the terms of these payment processors.
6. User Conduct and Responsibilities
You agree not to use the Service to:
a. Violate any applicable law or regulation.
b. Harass, abuse, threaten, or harm Drivers or other users.
c. Submit false or misleading information.
d. Impersonate another person or entity.
e. Interfere with or disrupt the Service or servers connected to the Service.
f. Use the Service for any illegal or unauthorized purpose.
7. Intellectual Property
The Service, including its original content, features, functionality, and branding, are the exclusive property of 17467184 Canada Inc. and its licensors and are protected by international copyright, trademark, and other intellectual property laws. Your use of the Service does not grant you any right, title, or interest in these properties.
8. Limitation of Liability
To the fullest extent permitted by law, 17467184 Canada Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to your use of the Service. While we strive to provide a reliable platform, we do not guarantee the availability, quality, or safety of the transportation services provided by third-party Drivers. Your transportation arrangement is a direct contract between you and the Driver. 17467184 Canada Inc. is not liable for the actions, omissions, or conduct of any Driver.
9. Termination
We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the “Last Updated” date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
